Olympus files patent lawsuit against Cantel/Medivators

Olympus has filed a lawsuit against Cantel Medical Corp. and Medivators Inc., “ARC Medical Design Limited et al v. Medivators Inc., et al,” about a patent or trademark, according to Justia Dockets and Filings. Arc Medical Design Limited is a former subsidiary of Norgine BV that was acquired by Olympus Corporation of the Americas last year, according to an Aug. 7, 2020 press release from Olympus.

The press release continued, Olympus will convert its current exclusive distribution rights of ENDOCUFF VISION to a full acquisition of the ENDOCUFF family of products, which also includes ENDOCUFF, ENDOCUFF GLIDE and ENTEROCUFF, as well as WIDE-EYE POLYTRAP and several products currently in development.

Arc Medical Design Limited announced that the High Court of Justice England and Wales, Patents Court ruled that ENDOCUFF and ENDOCUFF VISION UK national and UK (EP) patents (as amended) are valid and infringed by Cantel's AmplifEYE endoscopic device, and key design rights are valid and infringed by AmplifEYE, according to a Feb. 23, 2018 press release from APA-OTS. The patent and design rights had been challenged by Cantel Medical (UK) Limited and Cantel (UK) Limited, added the release.

The release continued, On Friday 23 February 2018 the High Court of Justice England and Wales, Patents Court ruled that Arc Medical Design Limited won on all counts:

· Arc Medical Design Limited's ENDOCUFF and ENDOCUFF VISION UK national patent 2478081 and UK(EP) patent 2575590, as amended, are valid and infringed;

· its ENDOCUFF VISION Registered Community Design 002523191-0001 is valid and infringed, its ENDOCUFF Registered Community Design 001856121-0001 is valid but not infringed; and

· its UK unregistered design rights in ENDOCUFF and ENDOCUFF VISION will be infringed from the date of the judgment.

· The judgment is for the UK market.
